I’ve heard talk that Florida Law does not allow a sitting Governor run for Federal offices. I’m here to set the record straight.
Florida law does not prevent Governor Ron DeSantis from leaving his term in office to run for federal office, including the presidency of the United States. However, the decision to resign from his current position as governor would be up to Governor DeSantis himself.
According to Florida law, a governor can resign from office at any time by delivering a letter of resignation to the Florida Secretary of State. Once the governor's resignation is effective, the lieutenant governor will assume the duties of the governor.
If Governor DeSantis were to resign to run for a federal office, he would need to comply with any applicable federal election laws and regulations, including filing the necessary paperwork with the Federal Election Commission and complying with fundraising and campaign finance rules.
If DeSantis runs in 2024, he risks alienating Florida voters who elected him as Governor for another four years, until 2026. It is highly unlikely he would win the Florida GOP Primary & no GOP candidate has ever won the GOP presidential nomination without winning Florida’s GOP Primary. Floridians will not support a candidate who broke their promise to Florida constituents
